2. WHAT REQUIREMENTS MUST YOU MEET TO PROVIDE US WITH YOUR PERSONAL DATA?
2.1. Be 18 years of age or older, or have your parents' or guardians' authorization. To provide us with your personal data, use the Website and contract our Programs, you must be of legal age (18+), have sufficient legal capacity and/or, where applicable, the prior and express authorization of your legal representatives (father and mother, both guardians if you have two, etc., as explained in the Terms and Conditions – https://thepower.education/terminos-y-condiciones). When you provide us with your data to use our services, you warrant that the data and information provided is real, truthful, up to date and, moreover, belongs to you and not to third parties. In addition, you must notify us of any change to the data provided, being responsible in any case for the truthfulness and accuracy of the data supplied at any given time.
Important: ThePower reserves the right to verify your age and identifying information at any time, including by requiring an official supporting document or equivalent procedure and, in the event that fraud is detected, or that it is verified or suspected that the User is a minor (under 18 years of age) or does not have the authorization of both parents or guardians, or has provided us with erroneous or false data, to temporarily deactivate and/or cancel your account. Likewise, if you select a username or identifier similar to another for your account, ThePower reserves the right to remove it, suggest another, or reclaim it.

When you access the Website, even if you have not registered, information is collected through ThePower's own cookies that you have accepted before starting to browse. Identifying personal information you provide us, which normally consists of your identifying data (first name and, where applicable, surnames), your email address and/or telephone number (depending on the medium used), as well as any other personal information you voluntarily include in the communications you send us.
Curricular, academic and professional information. In the event that you send us your curriculum vitae (CV), we may process the information relating to your studies, training, academic experience and any other information you have decided to include in it.
In the event that you have a telephone call with our commercial advisory team, we may process the recording of your voice and the content of that call, under the terms of section B.2.
B.2 For what purposes do we process this data?
1. Answering your requests. The main purpose of processing this data will be to answer your requests, resolve your queries and/or provide you with the information you ask us for, as well as, where applicable, to follow up on them.
2. Advising you by telephone about our Programs and activities (commercial contact). When you provide us with your contact details —in particular your telephone number— through any of the Website forms, campaigns, landing pages or messaging systems, and you expressly accept this Privacy Policy by checking the box provided for that purpose, you authorize one of our advisors to contact you by telephone (voice call) and/or by other equivalent means (WhatsApp, SMS or email) for the purpose of informing and advising you about the Program(s) in which you have shown interest, resolving your queries and recommending the training that best suits your needs. This contact is part of the advisory service you request from us by leaving us your details and may take place even if you do not ultimately contract any Program.
3. Recording of calls for quality purposes. Likewise, by providing your data and accepting this Privacy Policy, you expressly and knowingly consent that the telephone calls you have with our commercial advisory team may be recorded and stored. These recordings are made for the following purposes: (i) monitoring and improving the quality of the customer care and advisory service; (ii) training our staff; (iii) accurately recording your considerations, interests and statements in relation to the services we offer, as well as analyzing your suitability as a candidate (or lead) for our Programs; and (iv) evidencing, where applicable, the information provided and the conditions communicated during the call. Having given your consent at this time, you will not need to reiterate it during the call, notwithstanding that at the beginning of the call you will be informed that it may be being recorded. You may withdraw this consent at any time, as indicated in this Privacy Policy, without this affecting the lawfulness of the processing based on the consent given prior to its withdrawal.
4. Including you in our recruitment processes. If you send us your CV to take part in a recruitment process, we will process your personal information for that purpose, we will assess your profile and compare it with that of other candidates for a possible hiring.
5. Improving the customer care service. All the information derived from the queries, consultations and advice offered to interested parties, as well as the way in which requests are resolved, allows us to understand how we provide our own service and to know what we need to improve. Once the retention period indicated in B.4 has ended, all the information collected is anonymized, so that it ceases to be personal in nature.
B.3 What gives us the right or legitimizes us to process this data?
Your express consent, which you give us when you voluntarily contact us or leave us your details through any of these means to request information, send us other communications, or send us your CV in order to take part in our staff recruitment processes.
Your express and specific consent for commercial telephone contact and call recording, which you give us by checking the corresponding box and accepting this Privacy Policy at the time you provide us with your details, in order to: (i) receive telephone contact and contact by equivalent means from our advisors in relation to the Programs of interest to you; and (ii) allow such calls to be recorded for the purposes indicated in section B.2.3. This consent is voluntary and independent of the rest of the processing, and you may withdraw it at any time by writing to dpo@thepowermba.com with a copy to hola@thepowermba.com, or by communicating it during the call itself, without this affecting the lawfulness of the processing based on the consent prior to its withdrawal.
Our legitimate interest. All the information you voluntarily provide to our customer care department serves to analyze how that department works and improve the quality of the service we provide you, which we do on the basis of our legitimate business interest in providing an increasingly better service to our Users.
B.4 How long do we keep this information?
Your identifying personal information, as well as your CV and your professional data, will be processed while your requests are being handled. Once this period has ended, ThePower will keep the information in compliance with the law for a period that may be up to six years from the last communication we exchange.
Call recordings will be kept for the time necessary for the stated purposes and, in any case, for the period legally required to address possible liabilities arising from the processing and the commercial relationship; once that period has elapsed, they will be deleted or anonymized.
C. Likewise, we may process your data to send you our newsletter or publications of interest, or commercial communications
C.1 What data may we process?
Normally, your email address or your mobile telephone number, which we will have because you will have given them to us through the Website or by other means of communication, whether or not you have contracted any of the Programs.
C.2 What are the purposes of processing your personal data?
Sending publications of interest and commercial communications: if you maintain a contractual relationship with us or have subscribed to receive commercial information, we may send you, through electronic means (email, SMS, WhatsApp or others) and/or by telephone calls from our advisors, communications about products and services related to ThePower.
C.3 What gives us the right or legitimizes us to process this data?
Your express consent. If you no longer wish to receive this type of communication, you may withdraw it at any time by following the instructions indicated in the communication itself, or by writing to us at dpo@thepowermba.com with a copy to hola@thepowermba.com, so that we can unsubscribe you.
C.4 How long do we keep this data?
Until you decide to unsubscribe from our distribution list or inform us that you want to stop receiving commercial communications. From then on, we will keep this data, under the conditions established by law, for a period that may be up to six years from the sending of the last communication.
If you have provided us with this data for other purposes, we will continue to process it for those purposes provided you do not express your opposition, unless its processing is necessary to perform a current contract. Once this contract has ended, ThePower will keep your information under the conditions established by law for a period that may be up to six years from the last communication.
C.5 Does ThePower transfer to third parties the data you give us to receive commercial communications?
On occasion, we will transfer your data to intermediary entities in the contracting of financial services. The purpose of the transfer is the possibility of offering you the arrangement of financing for our services, through the signing of loan agreements with financial institutions, and may include the following purposes:
Handling the requests for information made and contacting you by telephone and/or email. Legitimizing basis: consent of the data subject.
Proceeding with their registration and managing enrollment in their files/system/platform. Legitimizing basis: consent given by the data subject.
Sending commercial communications relating to the services and promotions offered by said intermediary entities. Legitimizing basis: consent given by the data subject and, where a contractual relationship exists, the exception in article 21 of the Law on Information Society Services.
D. When you register on the Website as a Registered User and, subsequently, if you contract any of our educational services or Programs

In the event that you decide to register or log in through a third-party social network, we will have access to part of the information included in your public profile. During the subscription and/or use of the Services. Browsing Data referred to in Section A, depending on the cookies you have accepted; profile data (the mandatory ones marked with an asterisk [*] and those you provide voluntarily); information about participation in the Program (tasks and activities, interactions, grades, level of performance, training hours, issuance of certificates, etc.); image and voice when certain training activities require videoconferences; and information about transactions carried out (payment, billing and contact data, without storing the card number).
D.2 For what purposes do we process this data?
1. Registering you as a Registered User and providing you with our services, verifying that you are of legal age and enabling us to maintain, fulfill, develop, monitor and execute the services we offer you.
2. Managing the student's profile and record in relation to the training activity and the Programs.
3. Managing and organizing the videoconferences and training activities that require interaction between students and speakers by telematic means, which may be recorded for later consultation for educational or teaching purposes (which would involve recording your image and/or voice).
4. Managing and organizing your access to and use of our digital platform, where all the materials necessary to carry out the Programs are provided.
5. Managing and monitoring your progress as a student: attendance, grades, level of performance, training hours, efficiency analysis, issuance of certificates, etc.
6. Inviting you to events and other activities related to the Program and to networking actions or professional sector gatherings.
7. Fulfilling our obligations under the Terms and Conditions and the particular conditions of each Program, as well as resolving incidents.
8. Ordinary management and provision of our services, including sending administrative communications, updates, changes to the Terms and Conditions or to this Privacy Policy, and security alerts.
9. Preventing, detecting and reporting unlawful activities or activities contrary to the Terms and Conditions or that endanger the security of the information.
10. Requesting your participation in surveys and/or events or other activities exclusive to members of the ThePower Community.
D.3 What gives us the right or legitimizes us to process this data?
Your express consent, which you give us when you voluntarily register as a Registered User by filling in the mandatory fields of the registration form (marked with an asterisk [*]), or when you voluntarily provide us with your data to access activities, complete surveys or attend networking events.
The performance of the contract you sign with us when you contract one of our Programs. The processing of your personal data is, in general, necessary to perform the contractual relationship generated when you subscribe to any of our Programs.
Our legitimate interest. All the information you voluntarily provide us during registration and afterwards serves us to analyze the quality of our services, Programs and care, on the basis of our legitimate business interest in providing you with increasingly better value.
D.4 How long do we keep this data?
We will keep the information used to register you as a Registered User for as long as you do not decide to unsubscribe. We will keep the information used to contract a Program for as long as our contractual relationship remains in force. We will keep the information used to include you in activities or events for the time necessary for you to receive the specific service. Once you decide to unsubscribe, the contractual relationship has ended, or the purpose has been fulfilled, we will keep your information in accordance with current legislation, for a period that may be up to six years from the last communication.
D.5 Does ThePower transfer this data to third parties?
In addition to the transfers indicated in point 4, we may share some basic identifying data with the students of the courses in which you have enrolled, for informational purposes and for the proper conduct of joint activities (if you post a comment or question on the platform, your information, including your name, may be visible to other users).
Only in the event that you are taking one of our Programs financed by a company that has contracted our services, we may share with said company your identifying data, grades and level of development and performance in the Program. By accepting this Privacy Policy, you expressly consent that we share this data, which we also make available to your company because it has a legitimate interest in knowing it, since it is your company that pays for the program.
E. When you post comments on our blog
E.1 What data may we process?
Basic identifying and contact data, indicated in the corresponding form. You may select an alias or pseudonym in the event that you do not wish to publish your name.
E.2 For what purposes do we process this data?
Publishing comments on the blog. Through the corresponding form you can post a comment with your opinion on the topics that appear on the blog. Requesting the email is necessary for security and fraud prevention purposes. When you post a comment, it will be visible to all Users who visit the Website, and you are solely responsible for the content you post. It is not permitted to publish obscene, offensive, vulgar, denigrating, defamatory, violent content or, in general, content contrary to the law, morality and public decency or to our Terms and Conditions. ThePower reserves the right to remove comments that violate these rules.
E.3 What gives us the right or legitimizes us to process this data?
Your express consent, which you give us by providing the data through the corresponding form and freely and voluntarily publishing your comments on the blog. Our legitimate business interest in maintaining, managing and analyzing the quality of the blog and preventing possible unlawful acts.
E.4 How long do we keep this information?
For as long as the post is published on the blog or for as long as you do not request its removal or the cancellation of your data. From then on, we will keep the information in accordance with current legislation, for a period that may be up to six years from the last communication.
F. ThePower's presence on social networks
ThePower has a profile on the main social networks (Facebook, Twitter/X, Instagram, LinkedIn or YouTube). When you become a follower of any of our pages, the processing of the data will be governed by the terms of use, privacy policies and access regulations of the corresponding social network, which are external to ThePower and outside our control.
As a user of said social networks, ThePower complies with their rules in order to properly manage its presence and may inform you of activities, products or services, as well as contact you for any other purpose that the regulations of said networks allow.
When you express your interest in our services, ThePower may consult your professional profile on professional social networks, as well as in official gazettes and journals, press media, directories of electronic communications services, membership data of professional associations and other files whose consultation is not prevented by a restrictive rule. This processing is based on a legitimate interest of ThePower and will be limited to the information strictly necessary to locate you professionally.
4. TO WHOM MIGHT WE TRANSFER YOUR PERSONAL INFORMATION?
To the entities of its Business Group (among which are ThePower, Inc. and PowerBusinessSchool, S.L.) for the purposes stated in this Privacy Policy.
To public bodies, judges and courts and, in general, the Administration and competent authorities, when ThePower has a legal obligation to provide them.
To the Tax Authorities, for compliance with tax obligations, as well as to financial institutions for the management of collections and payments.
To companies that may collaborate with ThePower in detecting fraud in the use of the Website and of the content and services offered on it.
To the providers that render telephony, recording, storage and CRM services necessary to manage the commercial contact and the recordings described in section B, which act as data processors on behalf of ThePower and in accordance with its instructions.

6. CLOSING YOUR ACCOUNT AND WITHDRAWAL FROM THE CONTRACTUAL RELATIONSHIP
To cancel your Registered User account or to withdraw from the contracted Programs, you must follow the procedure indicated in our Terms and Conditions, in addition to the provisions of the particular conditions of each Program.
Important: if you withdraw and/or request cancellation (closing of your account) by sending an email to hola@thepowermba.com, you will lose the right to use any benefits or services that you may have active as of the cancellation date and/or have contracted previously.
In the above cases, we will keep your data blocked, under the conditions established by law, for a period that may be up to six years from the last communication we exchange.

D.2 For what purposes do we process this data?
1. Registering you as a Registered User and providing you with our services, verifying that you are of legal age and enabling us to maintain, fulfill, develop, monitor and execute the services we offer you.
2. Managing the student's profile and record in relation to the training activity and the Programs.
3. Managing and organizing the videoconferences and training activities that require interaction between students and speakers by telematic means, which may be recorded for later consultation for educational or teaching purposes (which would involve recording your image and/or voice).
4. Managing and organizing your access to and use of our digital platform, where all the materials necessary to carry out the Programs are provided.
5. Managing and monitoring your progress as a student: attendance, grades, level of performance, training hours, efficiency analysis, issuance of certificates, etc.
6. Inviting you to events and other activities related to the Program and to networking actions or professional sector gatherings.
7. Fulfilling our obligations under the Terms and Conditions and the particular conditions of each Program, as well as resolving incidents.
8. Ordinary management and provision of our services, including sending administrative communications, updates, changes to the Terms and Conditions or to this Privacy Policy, and security alerts.
9. Preventing, detecting and reporting unlawful activities or activities contrary to the Terms and Conditions or that endanger the security of the information.
10. Requesting your participation in surveys and/or events or other activities exclusive to members of the ThePower Community.
D.3 What gives us the right or legitimizes us to process this data?
Your express consent, which you give us when you voluntarily register as a Registered User by filling in the mandatory fields of the registration form (marked with an asterisk [*]), or when you voluntarily provide us with your data to access activities, complete surveys or attend networking events.
The performance of the contract you sign with us when you contract one of our Programs. The processing of your personal data is, in general, necessary to perform the contractual relationship generated when you subscribe to any of our Programs.
Our legitimate interest. All the information you voluntarily provide us during registration and afterwards serves us to analyze the quality of our services, Programs and care, on the basis of our legitimate business interest in providing you with increasingly better value.
D.4 How long do we keep this data?
We will keep the information used to register you as a Registered User for as long as you do not decide to unsubscribe. We will keep the information used to contract a Program for as long as our contractual relationship remains in force. We will keep the information used to include you in activities or events for the time necessary for you to receive the specific service. Once you decide to unsubscribe, the contractual relationship has ended, or the purpose has been fulfilled, we will keep your information in accordance with current legislation, for a period that may be up to six years from the last communication.
D.5 Does ThePower transfer this data to third parties?
In addition to the transfers indicated in point 4, we may share some basic identifying data with the students of the courses in which you have enrolled, for informational purposes and for the proper conduct of joint activities (if you post a comment or question on the platform, your information, including your name, may be visible to other users).
Only in the event that you are taking one of our Programs financed by a company that has contracted our services, we may share with said company your identifying data, grades and level of development and performance in the Program. By accepting this Privacy Policy, you expressly consent that we share this data, which we also make available to your company because it has a legitimate interest in knowing it, since it is your company that pays for the program.

E.1 What data may we process?
Basic identifying and contact data, indicated in the corresponding form. You may select an alias or pseudonym in the event that you do not wish to publish your name.
E.2 For what purposes do we process this data?
Publishing comments on the blog. Through the corresponding form you can post a comment with your opinion on the topics that appear on the blog. Requesting the email is necessary for security and fraud prevention purposes. When you post a comment, it will be visible to all Users who visit the Website, and you are solely responsible for the content you post. It is not permitted to publish obscene, offensive, vulgar, denigrating, defamatory, violent content or, in general, content contrary to the law, morality and public decency or to our Terms and Conditions. ThePower reserves the right to remove comments that violate these rules.
E.3 What gives us the right or legitimizes us to process this data?
Your express consent, which you give us by providing the data through the corresponding form and freely and voluntarily publishing your comments on the blog. Our legitimate business interest in maintaining, managing and analyzing the quality of the blog and preventing possible unlawful acts.
E.4 How long do we keep this information?
For as long as the post is published on the blog or for as long as you do not request its removal or the cancellation of your data. From then on, we will keep the information in accordance with current legislation, for a period that may be up to six years from the last communication.
F. ThePower's presence on social networks
ThePower has a profile on the main social networks (Facebook, Twitter/X, Instagram, LinkedIn or YouTube). When you become a follower of any of our pages, the processing of the data will be governed by the terms of use, privacy policies and access regulations of the corresponding social network, which are external to ThePower and outside our control.
As a user of said social networks, ThePower complies with their rules in order to properly manage its presence and may inform you of activities, products or services, as well as contact you for any other purpose that the regulations of said networks allow.
When you express your interest in our services, ThePower may consult your professional profile on professional social networks, as well as in official gazettes and journals, press media, directories of electronic communications services, membership data of professional associations and other files whose consultation is not prevented by a restrictive rule. This processing is based on a legitimate interest of ThePower and will be limited to the information strictly necessary to locate you professionally.
4. TO WHOM MIGHT WE TRANSFER YOUR PERSONAL INFORMATION?
To the entities of its Business Group (among which are ThePower, Inc. and PowerBusinessSchool, S.L.) for the purposes stated in this Privacy Policy.
To public bodies, judges and courts and, in general, the Administration and competent authorities, when ThePower has a legal obligation to provide them.
To the Tax Authorities, for compliance with tax obligations, as well as to financial institutions for the management of collections and payments.
To companies that may collaborate with ThePower in detecting fraud in the use of the Website and of the content and services offered on it.
To the providers that render telephony, recording, storage and CRM services necessary to manage the commercial contact and the recordings described in section B, which act as data processors on behalf of ThePower and in accordance with its instructions.

6. CLOSING YOUR ACCOUNT AND WITHDRAWAL FROM THE CONTRACTUAL RELATIONSHIP
To cancel your Registered User account or to withdraw from the contracted Programs, you must follow the procedure indicated in our Terms and Conditions, in addition to the provisions of the particular conditions of each Program.
Important: if you withdraw and/or request cancellation (closing of your account) by sending an email to hola@thepowermba.com, you will lose the right to use any benefits or services that you may have active as of the cancellation date and/or have contracted previously.
In the above cases, we will keep your data blocked, under the conditions established by law, for a period that may be up to six years from the last communication we exchange.
